1. Agreement to Terms

These Terms of Use ("Terms") govern your access to and use of the website at https://redwhiteandball.com (the "Site") and any related services for the Red, White & Ball basketball tournament (the "Event") operated by Next Level Basketball ("we," "us," "our"). By accessing the Site or registering for the Event, you agree to be bound by these Terms. If you do not agree, do not use the Site.

2. Eligibility

You must be at least 18 years old to register a team or sign a waiver on behalf of a minor player. Players must meet the age and grade eligibility for their respective division. By registering, you represent that you have the legal authority to register the players listed and to sign the waivers on their behalf.

3. Registration and Fees

• Registration is per team. All required fields must be completed truthfully and completely.
• Pricing and the early-bird window are stated on the Site at time of registration and are subject to change for future events.
• Payment is processed by Stripe. By submitting payment information, you authorize the stated charge.
• Refund policy: refunds are issued only as stated in the registration confirmation. Weather-related rescheduling does not automatically entitle a refund unless the Event is fully canceled.

4. Code of Conduct

The Event is a community youth basketball tournament. We expect players, coaches, parents, and spectators to behave with sportsmanship and respect. We reserve the right to remove any individual or team from the Site, registration, or the Event for conduct we determine to be unsafe, abusive, discriminatory, or otherwise inconsistent with the spirit of a youth event. No refunds will be issued for removal due to conduct.

5. Intellectual Property

All content on the Site — including the Red, White & Ball name, logo, wordmark, text, images, graphics, and code — is owned by Next Level Basketball, Pearl City Media, or our licensors, and is protected by copyright and trademark law. You may not copy, reproduce, distribute, or create derivative works from any of it without our prior written permission, except for personal, non-commercial sharing of public-facing Event information.

6. Third-Party Services

The Site relies on third-party services including Stripe (payments), DocuSeal (waivers), Flowroute (SMS), and others. Your use of those services is also governed by their respective terms. We are not responsible for the practices or policies of third parties.

7. Disclaimers

The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Participation in the Event involves inherent risk of injury, which is addressed in the Event waiver.

8. Limitation of Liability

To the maximum extent permitted by law, Next Level Basketball, Pearl City Media, and their officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site or participation in the Event. Our total aggregate liability for any claim related to the Site shall not exceed the amount you paid us for the relevant registration.

9. Indemnification

You agree to indemnify, defend, and hold harmless Next Level Basketball, Pearl City Media, and our officers, directors, employees, and agents from any claim, demand, liability, damage, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Site, your registration, or your or your players' participation in the Event, except to the extent caused by our own gross negligence or willful misconduct.

10. SMS Terms

If you opt into SMS messaging during registration, our SMS Terms are incorporated into these Terms by reference.

11. Governing Law and Venue

These Terms are governed by the laws of the State of Iowa, without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising out of or relating to these Terms or the Site shall be the state and federal courts located in Muscatine County, Iowa, and you consent to the jurisdiction of those courts.

12. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
